Terms & Conditions

The owners of Edinburgh Beach View Apartment, /we/our/us) offer for sale holiday accommodation via www.edinburgh-beach-view-apartment.co.uk (the “Website”), using the booking form that is available on the website, via email requests, direct requests for bookings and requests for bookings via third party advertising.

Any person wishing to book a holiday via any of these methods (referred to as “you/your”) acknowledges that such a booking is made subject to our terms and conditions as set out below.

You may only request a booking if you agree to these terms and conditions. By requesting a booking, you are deemed to have accepted these terms and conditions as governing your booking.

This does not affect your statutory rights as a consumer.

We reserve the right to change these terms and conditions at any time. Any such changes will take effect immediately when posted on the Website, at the cottage, or otherwise brought to your attention. It is your responsibility to read the terms and conditions each time you request a booking and any such request shall signify you have accepted to be bound by the latest set of terms and conditions.

1. Payments, Booking Policy & Process

A booking is secured by the payment of a 25% deposit. The account will be settled 2 months before check-in by payment of the remaining 75%. If payment of the remaining 75% is overdue by more than 10 days, the stay period will be offered for resale. All bookings made less than two months before check-in must be paid in full at the time of booking. Until the deposit is payed the period in question will remain on sale and available to other prospective guests.

Payments are possible online via PayPal or similar service providers. Please note that a PayPal account isn’t required to make a payment through PayPal as credit and debit cards are accepted.

Although it is envisaged that most payments will be made on-line or by internet banking. Where guests choose to pay by cheque and post the stay period in question will remain on sale and available to other prospective guests until the cheque arrives. Upon receipt of the cheque the period in question will be marked as unavailable. The booking will be confirmed only once the cheque clears and the moneys are available in the owner’s bank account.

When you wish to place a booking for a holiday with us, you will complete the order process online. It is your responsibility to provide us with the correct information. If you have made the Booking Request via the telephone, we will read back your details to you. You will be responsible for the Booking regarding any input errors.

For all other Booking Requests that we process, we shall issue written confirmation accepting your Booking Request with a booking reference number.

Once Edinburgh Beach View Apartment has issued such written or email confirmation it shall have entered into a contract with you.

By making a Booking Request you warrant that you have the authority of all persons in your party to book on their behalf, accept these terms and conditions and that you will indemnify Edinburgh Beach View Apartment and keep Edinburgh Beach View Apartment fully and effectively indemnified against all loss and damage arising directly or indirectly, from any act or default by yourself or any person or animal accompanying you.

Bookings are not transferable.

The apartment is in a peaceful residential area if anyone fails to respect this, we reserve the right to ask guests to leave the property at any time. Similarly, guests are not permitted to host events, parties, sublet the property, etc. If you are asked to leave under these circumstances, no monies will be refunded.

2. Services, Features and Facilities

Apart from your holiday accommodation none of the features, facilities or services referred to in the Website (e.g. bike hire, pony trekking and boat hire etc) are provided by Edinburgh Beach View Apartment or its agents (unless otherwise stated). We shall not have any responsibility for loss, damage or injury in relation to these features, facilities and services which we do not provide.

Information about features, facilities and services at your holiday, is, to the best of our knowledge and belief, accurate at the time of publication of the Website, but some of these features, facilities and services may not be available at the time you take your holiday.

3. Amendments

If you want to amend your booking you must notify us as soon as possible. Amendments to your booking can be made up to 12 weeks prior to the start date of your holiday and are subject to availability and to a £20 administration fee.

Should you wish to transfer your booking to another date, we will use our reasonable endeavours to satisfy your request wherever possible, but shall be under no obligation to do so.

4. Pricing

The price for the accommodation fluctuates in line with seasonal changes and market pressures. Every attempt is made to offer good quality accommodation at fair and competitive prices.

5. Occupants

The maximum number of people occupying must not exceed 4 adults unless by prior arrangement. This does not include infants under the age of 2 and a travel cot and bedding can be made available on request.

6. Dogs & Pets

Dogs and pets are not accepted.

7. Arrival and Departure

Check-in time is 4.00pm on the agreed date of arrival. If you are likely to arrive late, please let us know.

Check-out time is no later than 11.00am on your agreed date of departure.

8. Your Responsibility

The accommodation must be left in a reasonably clean and tidy condition. Please make us aware of any breakages or damage caused during your stay.

Edinburgh Beach View Apartment shall be entitled to charge you for any costs or expenses it incurs as a result of any breakage or damage or a failure by you to leave the accommodation in a clean and tidy condition.

9. Cancellation and breakage cover

We advise customers to take out cancellation and breakage cover.

10. Mobility Difficulties

The apartment is on the first floor and is not generally suitable for persons with mobility difficulties.

11. Complaints

We will do all that we can to make you feel welcome and present you with accommodation in good order. Should you nevertheless have cause for complaint, please contact us immediately and we will endeavour to resolve any reasonable issue. If we are unable to do so we will advise you of our complaints procedure.

12. Promotions and Special Offers

Promotions or discounted offers are provided at the discretion of Edinburgh Beach View Apartment. All offers are subject to availability and may be withdrawn at any time.

13. Third Parties

Reference to any products, services processes, trade names, trademarks or other information of third parties does not imply or constitute an endorsement, sponsorship or recommendation by Edinburgh Beach View Apartment

Links to other services not operated by us are solely for your convenience. Edinburgh Beach View Apartment are not responsible for any products, services, processes, trade names, trademarks or other information provided by third parties.

14. Disclosure

By agreeing to these terms and conditions you are agreeing to abide by all of our policies which are available at our site.

15. Liability

Unless required by law, we will not be liable to you for any loss of profit, loss of business or loss of goodwill or for any indirect or consequential losses whatsoever and our maximum liability shall be no more than to refund the amount paid by you for the holiday.

We shall have no liability to you for any failure to perform any of our obligations under the contract if and to the extent that the failure is caused by act of God, governmental restriction, condition or control or by reason of any act done or not done pursuant to trade dispute, shortages of labour or materials or breakdown of machinery or any other matter (whether or not similar to the foregoing) outside of our control.

The owners shall not be held responsible or liable for any accident,loss or mishap occurring whilst on or using the premises, or for any illness or injury arising from any cause whatsoever.

No liability is accepted by the owner for loss or damage to baggage,motor etc. however caused.

No liability is accepted by the owner for any consequences regarding use of the internet on the premises. The owner only provides a means to connect guests own equipment to the internet and full liability is on the tenant/guest for internet use.

If the cottage becomes unavailable or unsuitable for rental for any reason whatsoever, the owners liability shall be limited to the amount of rent paid

The owner reserves the right to refuse entry to the cottage to anyone who in the opinion of the owner is not suitable to take charge of the cottage.

The owner reserves the right of access to the property at all reasonable times.

16. Third Party Rights

No person (except you and us) shall have any rights pursuant to the Contract (Rights of Third Parties) Act 1999 (the “Act”) to enforce any of these terms and conditions. Any right or remedy of a third party which exists or is available apart from the Act is not affected.

17. Governing Law

These terms and conditions shall be governed and interpreted exclusively according to the laws of Scotland.

We and you agree to submit to the exclusive jurisdiction of the Scottish Courts in relation to any matters of dispute arising out of or in connection with these conditions provided that we may, at our option, take proceedings in the courts of the state or country in which you are domiciled including action to obtain any remedy (including injunctive relief).

Full liability is on the guest/s for internet use. (see clause 17 above).
